Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Virtsona (the “Service”), operated by Lucid Life Media (“Virtsona,” “we,” “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Virtsona lets you create AI-generated characters and generate, schedule, and publish short-form videos to connected social accounts (such as TikTok). The Service relies on third-party AI providers to generate media and on third-party platforms to publish it.

2. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract. You are responsible for the activity under your account and for keeping your sign-in method secure. Provide accurate information and keep it up to date.

3. AI-generated content & your responsibilities

You are responsible for the characters you create, the prompts you provide, and the content you publish. You agree that you will not use the Service to:

  • Depict, impersonate, or create a likeness of a real person (including public figures or celebrities) without their consent.
  • Generate or publish content that is unlawful, sexually explicit, hateful, deceptive, or that infringes others’ rights.
  • Violate the terms, policies, or community guidelines of any platform you connect or publish to (including TikTok).

Virtsona screens generated content with automated moderation and labels published content as AI-generated where required, but you remain responsible for ensuring your content complies with applicable law and platform rules.

4. Connected social accounts

When you connect a third-party account (e.g. TikTok), you authorize Virtsona to publish content on your behalf according to your settings and automations. You may disconnect at any time. Your use of those platforms is also governed by their own terms.

5. Subscriptions, trials & billing

Paid plans are billed on a recurring basis through our payment processor, Stripe. New accounts may include a free trial; if you do not add a payment method or cancel before the trial ends, your access to paid features ends. You can cancel at any time, effective at the end of the current billing period. Except where required by law, payments are non-refundable. Generation allowances are per the plan you select.

6. Acceptable use

Do not misuse the Service: no attempts to circumvent usage limits or security, no automated abuse, no reselling generations, and no use that imposes an unreasonable load or that we reasonably believe is fraudulent or harmful. We may suspend or terminate accounts that violate these Terms.

7. Intellectual property

Subject to your compliance with these Terms and applicable third-party terms, you retain rights to the content you generate, to the extent such rights are available for AI-generated output under applicable law. The Service itself, including its software and branding, remains our property. You grant us the limited rights needed to operate the Service (e.g. to process, store, moderate, and publish your content on your behalf).

8. Third-party services

The Service integrates with third parties including TikTok (publishing), Stripe (payments), and AI model providers (content generation). We are not responsible for third-party services, and their availability or terms may change.

9. Disclaimers

The Service is provided “as is” without warranties of any kind. AI output can be inaccurate or unexpected; you are responsible for reviewing content before relying on or publishing it. We do not warrant uninterrupted or error-free operation.

10. Limitation of liability

To the maximum extent permitted by law, Virtsona will not be liable for any indirect, incidental, or consequential damages, and our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or to protect the Service. Provisions that by their nature should survive termination will survive.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by updating the date above; your continued use after changes take effect constitutes acceptance.
